Customer Terms Agreement
Effective date: February 3, 2026
1. Scope of this Agreement
These Customer Terms (the "Terms") govern your use of the JS Factory apps, including but not limited to Service Desk Checklist and Instructions for Service Desk Agents (collectively, the "Apps"), when installed from the Atlassian Marketplace and used with Atlassian Jira Service Management/Jira Service Desk.
These Terms apply only to the Apps as provided by JS-Factory - Krzysztof Gorzelak Consulting ("we", "us", "our") and do not apply to the Atlassian platform itself or any other third-party apps or services.
These Terms should be read together with our Service Level Agreement and Privacy Policy, which are available on our website.
2. License and Permitted Use
Subject to these Terms and your compliance with the applicable Atlassian Marketplace and Atlassian Cloud Terms of Service, we grant you a limited, non-exclusive, non-transferable, revocable license to install and use the Apps within your Atlassian Cloud instance for your internal business purposes.
3. Usage Restrictions
You agree not to, and will not permit others to:
- Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of the Apps, except to the extent expressly permitted by applicable law.
- Sell, resell, sublicense, rent, lease, or otherwise distribute the Apps to any third party, except via the Atlassian Marketplace as permitted by Atlassian.
- Use the Apps for any illegal or unauthorized purpose, or in a manner that infringes the rights of any third party.
4. Data and Privacy
We do not store personal or other data outside of Atlassian systems. All functional information (such as checklist content and agent instructions) remains within your Jira Service Management/Jira Service Desk instance.

5. Support and Service Levels
Support for the Apps is provided via our Atlassian support portal at https://js-factory.atlassian.net/servicedesk/customer/portal/5. Our current Service Level Agreement (SLA) for response times and availability is published separately on our website. The SLA applies only to the Apps and does not extend to the Atlassian platform itself.
6. Disclaimers and Limitation of Liability
The Apps are provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or business opportunities, arising out of or in connection with your use of the Apps.
We are not responsible for any unavailability, performance issues, or data loss caused by the Atlassian platform, your network, or any third-party services. Our total aggregate liability arising out of or related to the Apps shall be limited to the fees paid by you for the Apps during the one (1) month period immediately preceding the event giving rise to the claim, or the minimum amount required by applicable law, whichever is greater.
7. Atlassian Platform and Marketplace
Your use of the Apps is also subject to Atlassian's applicable terms and policies, including the Atlassian Cloud Terms of Service and the Atlassian Privacy Policy. In case of any conflict between these Terms and Atlassian’s terms, Atlassian’s terms will prevail with respect to the Atlassian platform and Marketplace.
8. Refunds and Cancellations
Any purchases, renewals, refunds, or cancellations of the Apps are handled through the Atlassian Marketplace in accordance with Atlassian’s Marketplace and billing policies. Please refer to the Atlassian Marketplace documentation and your Atlassian account for details on refunds and cancellation procedures.
9. Term and Termination
These Terms remain in effect for as long as you have the Apps installed and active in your Atlassian instance, or until terminated in accordance with this section.
You may terminate your use of the Apps at any time by uninstalling them via your Atlassian administration settings, subject to Atlassian Marketplace rules.
We may suspend or terminate your access to the Apps if required by Atlassian, if you materially breach these Terms, or if your Atlassian subscription is suspended or terminated, in each case in accordance with the Atlassian Marketplace rules and policies.
10. Intellectual Property
The Apps, including all related software, documentation, designs, and other materials, are and shall remain the exclusive property of JS-Factory - Krzysztof Gorzelak Consulting, except for any third-party components used under license.
All data and content created or stored within your Jira instance using the Apps (including checklist content, agent instructions, and other functional data) are owned and controlled by you or your organization as the customer.
11. Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of Poland, without regard to its conflict of laws principles. Any disputes arising out of or in connection with these Terms or your use of the Apps shall be subject to the exclusive jurisdiction of the courts of Poland, unless otherwise required by applicable law.
12. Changes to these Terms
We may update these Terms from time to time. The current version will always be available on our website or within the App documentation. Notification of changes is provided by updating the effective date at the top of this document. Your continued use of the Apps after the effective date of any changes constitutes your acceptance of the updated Terms.
